DPC files writ in Bombay HC
against MERC order

United States energy major Enron's Dabhol Power Company (DPC) on Wednesday filed a writ petition in the Bombay High Court, challenging the May 29 order of the Maharashtra Electricity Regulatory Commission (MERC), that had refrained the multinational from activating the escrow account and its jurisdiction over solving the current imbroglio with the state electricity board (MSEB).

The MERC had also passed a temporary injunction asking DPC not to pursue its arbitration proceedings till the final hearing and disposal of the petition filed by MSEB.

"DPC filed the petition on Wednesday when the court opened after the summer vacation," state government sources said in Bombay.

Sources said neither MSEB nor the state government had been served with notices.

The petition would come up for hearing on June 11, the sources added.
